TERMS OF SERVICE
Effective Date: 9/28/26
These Terms of Service (“Terms”) govern your access to and use of the website, services, reports, research, and other materials provided by Collision IQ LLC (“Collision IQ,” “we,” “us,” or “our”).
By accessing our website, purchasing a service, submitting information or documents, or otherwise using our services, you agree to these Terms. If you do not agree to these Terms, do not purchase or use our services.
1. Our Services
Collision IQ provides independent vehicle valuation research and related informational services.
Depending on the service purchased, Collision IQ may:
- review a vehicle valuation report prepared by an insurance company, valuation vendor, or other third party;
- review information concerning a vehicle, including its year, make, model, trim, mileage, equipment, condition, and geographic market;
- research vehicles offered for sale that may be relevant to determining the market value of the vehicle being evaluated;
- identify potential discrepancies, omissions, adjustments, or valuation issues in third-party valuation reports;
- perform market-comparable and vehicle-feature research;
- prepare valuation analyses, reports, supporting documentation, or evidence packets; and
- provide other vehicle valuation research identified in the applicable service description.
Our services are intended to provide information and research that a customer, attorney, or other authorized recipient may independently consider and use.
2. Collision IQ Is Not Your Attorney
Collision IQ is not a law firm and does not provide legal advice or legal representation.
Nothing provided by Collision IQ creates an attorney-client relationship between you and Collision IQ.
Our reports may identify factual or valuation-related information that could potentially be relevant to an insurance claim or dispute, but we do not determine your legal rights, interpret insurance coverage for you, provide legal advice regarding a claim, or advise you regarding whether to accept or reject a settlement.
You should consult a qualified attorney regarding legal questions or legal rights associated with an insurance claim.
3. Collision IQ Is Not Your Insurance Company or Insurance Representative
Collision IQ is independent from insurance companies and insurance valuation vendors unless expressly disclosed otherwise.
Collision IQ is not affiliated with, endorsed by, or acting on behalf of CCC Intelligent Solutions, Mitchell, Audatex, insurance carriers, vehicle manufacturers, dealerships, listing websites, or other companies whose information may appear in our research.
Unless Collision IQ separately agrees in writing to perform a particular service and is legally authorized to do so, Collision IQ does not act as your insurance adjuster, public adjuster, insurance agent, attorney-in-fact, or representative in communications or negotiations with an insurance company.
Our standard service consists of research, analysis, and preparation of materials for your use or for the use of an attorney or other authorized representative.
You remain responsible for deciding whether, when, and how to submit any Collision IQ report or supporting material to an insurance company or other party.
4. No Guarantee of Increased Valuation or Settlement
Purchasing a Collision IQ service does not guarantee that:
- an insurance company will change its valuation;
- an insurance company will increase an offer or settlement;
- a particular comparable vehicle will be accepted by an insurance company;
- a valuation methodology or argument will be accepted;
- a claim will be resolved in your favor; or
- you will recover any particular amount of money.
Insurance carriers, attorneys, courts, arbitrators, appraisal participants, and other parties may reach conclusions different from Collision IQ.
The fee charged by Collision IQ is for the research and services performed and is not contingent upon a particular outcome unless expressly stated in a separate written agreement.
5. Nature and Limitations of Vehicle Valuation Research
Vehicle valuation is inherently dependent upon available data and professional judgment.
Our analysis may rely on information including:
- online vehicle listings;
- dealership advertisements;
- vehicle history information;
- valuation reports;
- equipment and option information;
- mileage;
- geographic location;
- market conditions;
- photographs;
- documents provided by you;
- publicly or commercially available information; and
- other relevant data sources.
Vehicle advertisements ordinarily reflect asking prices rather than confirmed final sale prices unless expressly identified otherwise.
Online listings may be changed, removed, sold, or become unavailable after our research is completed.
Market conditions may also change after the date of our analysis.
Unless expressly stated otherwise, a Collision IQ report is not a certified appraisal and should not be represented as one.
Our conclusions apply to the information reasonably available to us at the time the work is performed.
6. Customer Information and Cooperation
You agree to provide information that is accurate, complete, and not knowingly misleading.
You are responsible for reviewing the information submitted with your order, including vehicle information and uploaded documents.
You agree to promptly notify Collision IQ if you discover a material error in information you provided.
Collision IQ may rely upon information contained in documents supplied by you without independently verifying every fact in those documents.
Incomplete, inaccurate, conflicting, or missing information may affect our analysis or prevent us from completing a service.
We may request additional information when reasonably necessary to complete your order.
7. Documents You Upload
You may be asked to upload documents such as:
- CCC, Mitchell, Audatex, or other vehicle valuation reports;
- insurance correspondence;
- vehicle information;
- repair estimates;
- photographs;
- window stickers;
- purchase or maintenance records; or
- other documents relevant to the requested analysis.
By submitting a document, you represent that you are legally permitted to provide it to Collision IQ and authorize Collision IQ to review and process it for purposes of providing the requested service.
You retain ownership of documents and information you provide.
You grant Collision IQ a limited right to copy, store, analyze, process, and reproduce those materials as reasonably necessary to provide the purchased services, maintain appropriate business records, comply with legal obligations, and resolve disputes relating to the service.
You should not provide information that is unnecessary for our work.
Unless specifically requested, please do not upload Social Security numbers, complete bank account numbers, complete payment-card numbers, passwords, medical records, or other highly sensitive information unrelated to the vehicle valuation.
8. Orders Submitted by Attorneys and Law Firms
Collision IQ may provide services directly to attorneys and law firms on behalf of their clients.
An attorney or law firm submitting information concerning a client represents that it has appropriate authority to provide the information and documents to Collision IQ and to engage Collision IQ for the requested service.
Unless otherwise agreed in writing, the attorney or law firm placing the order is responsible for providing instructions regarding where the completed materials should be delivered.
When an attorney or law firm purchases the service on behalf of a client, delivery of the completed work to the ordering attorney or law firm constitutes delivery of the service.
Collision IQ's work does not create an attorney-client relationship between Collision IQ and the law firm's client.
Nothing in these Terms is intended to define whether Collision IQ is acting as a consultant, expert, vendor, or other service provider to a law firm in a particular matter. Any additional responsibilities required for litigation, expert testimony, discovery, confidentiality, privilege, or consulting engagements must be addressed in a separate written agreement where appropriate.
9. Authorization to Deliver Materials to a Third Party
If you direct Collision IQ to provide completed materials to your attorney or another designated recipient, you authorize us to release those materials and related information to that recipient.
Collision IQ may take reasonable steps to verify the identity or authority of a requested recipient before releasing information.
You are responsible for ensuring that any email address or contact information you provide for a recipient is accurate.
10. Pricing and Payment
Prices are displayed on our website or otherwise communicated before purchase.
Payment is due at the time the order is placed unless Collision IQ has entered into a separate written billing arrangement with you.
Payments may be processed by a third-party payment processor. Collision IQ may not directly receive or store your complete payment-card information.
You authorize Collision IQ and its payment processor to charge the amount displayed at checkout, including any applicable taxes or fees disclosed before purchase.
11. Refunds and Cancellations
Because Collision IQ provides individualized research and analysis and may begin work shortly after an order is received, cancellation and refund rights are limited.
Unless otherwise stated at checkout or required by applicable law:
- an order may be canceled for a full refund if Collision IQ has not yet begun substantive work on the order;
- once substantive research, document review, analysis, or report preparation has begun, the service fee is nonrefundable; and
- if Collision IQ determines that it cannot reasonably perform the purchased service, Collision IQ may cancel the order and refund some or all of the amount paid, as appropriate.
Dissatisfaction with an insurer's response, failure to obtain an increased valuation, or disagreement by an insurer or another party with our analysis does not by itself entitle the customer to a refund.
Nothing in this section limits any non-waivable rights provided by applicable law.
12. Turnaround Times
Any turnaround time stated on our website or in communications with you is an estimate unless Collision IQ expressly guarantees a particular deadline in writing.
Completion may depend upon the quality and completeness of the documents and information provided.
Requests for additional information, unusual vehicle configurations, limited comparable inventory, technical issues, holidays, or other circumstances may affect completion time.
Collision IQ is not responsible for insurance-company, litigation, appraisal, statutory, contractual, or other deadlines unless we expressly agree in writing to accept responsibility for a specific deadline.
You remain responsible for monitoring all deadlines applicable to your claim or legal matter.
13. Corrections
We want our reports to accurately reflect the information used in our analysis.
If you believe a completed report contains a factual, mathematical, or clerical error, contact us promptly at support@collision-iq.net and identify the suspected error.
Collision IQ may correct confirmed errors in its work.
A request to add information that was not provided before completion, conduct additional research, update expired listings, evaluate newly supplied evidence, or materially change the scope of the original order may be treated as additional work and may require an additional fee.
14. Third-Party Information and Links
Our services may reference or link to information supplied by dealerships, vehicle marketplaces, insurance valuation companies, government sources, manufacturers, or other third parties.
Collision IQ does not control those third parties and is not responsible for changes to their websites, listings, products, records, or information.
A reference or link to a third party does not constitute an endorsement of that third party.
Third-party information may contain inaccuracies or may change without notice.
15. Intellectual Property
Except for materials supplied by customers or third parties, Collision IQ owns or licenses the website, report formats, written explanations, graphics, methodologies, templates, branding, and other original content used to provide our services.
When you purchase a Collision IQ report, Collision IQ grants you a nonexclusive license to use, copy, transmit, and submit the completed report and its supporting materials for purposes reasonably related to the vehicle, insurance claim, legal matter, or transaction for which the report was prepared.
You may provide the report to your attorney, insurance company, appraiser, court, arbitrator, regulator, or other person reasonably involved in that matter.
You may not resell, commercially redistribute, publish as your own work, remove Collision IQ branding from, or use our proprietary templates to create a competing product without our written permission.
Attorneys and law firms may use client-specific Collision IQ reports in connection with the matters for which those reports were commissioned.
16. Confidentiality and Privacy
Collision IQ will handle personal information in accordance with its Privacy Policy and applicable law.
Our Privacy Policy explains, among other things, what information we collect, why we collect it, how it may be used, the types of service providers with whom it may be shared, and choices or rights that may be available to users.
Please review the Privacy Policy here.
No method of electronic transmission or storage can be guaranteed to be completely secure. Collision IQ will use reasonable measures appropriate to the nature of the information it handles but cannot guarantee absolute security.
17. Acceptable Use
You may not use Collision IQ's website or services to:
- submit documents you have no legal right to possess or disclose;
- impersonate another person;
- provide knowingly false or fraudulent information;
- facilitate fraud or other unlawful conduct;
- interfere with the operation or security of the website;
- access systems or information without authorization;
- scrape, reverse engineer, or systematically copy proprietary portions of our website or services except as permitted by law; or
- use Collision IQ materials in a misleading manner.
We may refuse or discontinue service where we reasonably believe the service is being used unlawfully, fraudulently, abusively, or in violation of these Terms.
18. Right to Decline an Engagement
Collision IQ may decline, cancel, or discontinue an order where reasonably necessary, including when:
- sufficient information is unavailable to perform a meaningful analysis;
- information supplied appears materially inaccurate or fraudulent;
- the requested activity falls outside the services Collision IQ provides;
- completing the request could violate applicable law or licensing requirements;
- a conflict or other legal issue prevents Collision IQ from performing the work; or
- the customer materially violates these Terms.
If we discontinue an order before completing the purchased service, we will determine whether a full or partial refund is appropriate based on the work already performed and applicable law.
19. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLISION IQ'S WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
COLLISION IQ DOES NOT WARRANT THAT ITS SERVICES WILL PRODUCE A PARTICULAR INSURANCE, LEGAL, FINANCIAL, SETTLEMENT, OR VALUATION OUTCOME.
COLLISION IQ DOES NOT WARRANT THAT THIRD-PARTY INFORMATION WILL ALWAYS BE COMPLETE, CURRENT, OR ERROR-FREE.
Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COLLISION IQ AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITIES, OR LOSSES ARISING FROM A THIRD PARTY'S DECISION TO ACCEPT OR REJECT A VALUATION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COLLISION IQ'S TOTAL LIABILITY ARISING FROM A PARTICULAR PURCHASE OR SERVICE WILL NOT EXCEED THE AMOUNT PAID TO COLLISION IQ FOR THE SERVICE GIVING RISE TO THE CLAIM.
These limitations do not apply where liability cannot legally be limited or excluded.
21. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Collision IQ and its members, employees, contractors, and agents from third-party claims, liabilities, losses, and reasonable costs arising from:
- documents or information you submitted without authorization;
- your fraudulent or unlawful conduct;
- your material violation of these Terms; or
- your unauthorized or misleading alteration, publication, resale, or use of Collision IQ's work.
This section does not require you to indemnify Collision IQ for Collision IQ's own conduct where such indemnification is prohibited by law.
22. No Assignment of Insurance Claim
Purchasing Collision IQ's services does not assign or transfer any portion of your insurance claim, insurance proceeds, settlement rights, or legal claim to Collision IQ.
Unless expressly provided in a separate lawful written agreement, Collision IQ has no ownership interest in the proceeds of your insurance claim and its fee does not depend upon the amount ultimately paid by an insurer.
23. Communications
By placing an order, you authorize Collision IQ to communicate with you regarding your order using the contact information you provide.
Transactional communications may include requests for information, order-status messages, delivery notices, receipts, security notices, and customer-service communications.
Marketing communications, if any, will be handled in accordance with applicable law and the choices made available to you.
You are responsible for maintaining a valid email address and checking communications concerning your order.
24. Electronic Agreement
You agree that these Terms and other agreements or disclosures relating to your use of Collision IQ's services may be provided electronically.
By selecting a checkbox or other affirmative mechanism indicating agreement and then submitting an order, you intend to enter into a binding electronic agreement.
You may save or print a copy of these Terms for your records.
25. Changes to These Terms
Collision IQ may update these Terms from time to time.
The version applicable to a particular paid order will generally be the version presented or made available when that order is placed unless a change is required by law or you and Collision IQ expressly agree otherwise.
The effective date shown at the beginning of these Terms identifies the current version.
26. Governing Law
Except to the extent otherwise required by applicable law, these Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Nothing in these Terms is intended to deprive a consumer of mandatory protections that apply under the law of the consumer's jurisdiction and cannot legally be waived by contract.
27. Disputes and Venue
Before filing a lawsuit concerning Collision IQ's services, you agree to make a good-faith effort to contact Collision IQ at support@collision-iq.net and provide a reasonable opportunity to address the dispute informally.
Unless applicable law requires otherwise, any court proceeding arising out of these Terms or Collision IQ's services shall be brought in a court of competent jurisdiction located in Douglas County, Colorado.
Nothing in this section prevents either party from pursuing a matter in small claims court when the matter qualifies for that court.
28. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary, and the remaining provisions will continue in effect.
29. No Waiver
A failure by Collision IQ to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision on another occasion.
30. Entire Agreement
These Terms, together with the applicable order, service description, Privacy Policy, and any other written terms expressly incorporated into the transaction, constitute the agreement between you and Collision IQ concerning the purchased service.
If Collision IQ and a law firm, business customer, or other customer enter into a separate signed agreement that conflicts with these Terms, the separate signed agreement controls to the extent of the conflict.
